MTO axle weight moratorium update: Enforcement begins

July 13, 2016 – Phase 2 of the enforcement of axle weights by the Ministry of Transportation (MTO) will begin on Aug. 1, 2016. Charges will begin to be laid at inspection stations beginning Aug. 1.

Phase 2 will run from Aug 1, 2016 to March 31, 2017 and will consist of new enforcement thresholds and a new interim axle weight charge and detain for correction level. Charges will be issued and vehicles will be detained for correction when axle or gross weight exceeds the specified thresholds. These new levels are detailed in the chart below. All configurations of trucks will be affected by these changes, so review the chart to better understand how it will affect you specifically.

  • In all phases, a vehicle will not be permitted to exceed manufacturers’ Gross Vehicle Weight Rating (GVWR), Gross Axle Weight Rating (GAWR) and Tire Load Limits. 
  • Starting in Phase 2, all axles designed to load equalize will be required to load equalize to within the amount indicated in Section 14 of O.Reg. 413/05, Vehicle Weights and Dimensions -For Safe, Productive and Infrastructure-Friendly Vehicles (SPIF) Vehicles. 
  • Enforcement thresholds for all commercial motor vehicles with a GVWR of 11,000 kg or less will be 50% of the values listed above.
