Community group to pay appeal costs

November 26, 2015 – The Concerned Residents Association of North Dumfries (CRAND) has been ordered by the Ontario Municipal Board (OMB) to pay $110,000 to Preston Sand and Gravel following an appeal of a rezoning application.

According to the Cambridge Times, the amount represents half of the cost spent by Preston in fighting an appeal made by CRAND, which spent years fighting an approved application for a new aggregate pit.

CRAND had argued that the dust created by the new aggregate pit would be harmful to the health of residents living within a certain area of the pit.

The article stated the Zuidema’s decision was based on CRAND’s “failed to give notice without adequate explanation, exhibited a lack of co-operation with other parties during the prehearing proceedings, introduced issues or evidence not previously mentioned or included in a procedural order.”
